CUSTOMS STATUTE
Entry into force of the new Customs Statute
Decree 390 of February, 2016
On March 31st, 2016, the new Customs Statute entered into force, introducing new regulations regarding the following topics, among others:
- Signing and filing of import returns. As per the new Statute, the person that must sign the import and export return is the legal representative of the legal entity performing the operation. Prior to the issuance of the new Statute, the Customs Agency (SIA) used to sign all returns.
- Drafting of mandate agreements for the import and export of goods. It is possible that in the coming days, Customs Agencies request their customers to modify the agreements to adjust to the new parameters established in the new Statute.
- Customs Value Returns. With the new Customs Statute, from March 31th onwards, the Customs Agency will no longer be able to sign the value returns. If they do sign them, they will be liable for their content.
