PROCEDURE FOR THE REGISTRATION OF GEOPHRAPHICAL INDICATIONS AND DENOMINATIONS OF ORIGIN OF THE EUROPEAN UNION
On November 2017, Resolution No. 319-E/2017 was published, by means of which the Agroindustria Ministry regulated the procedure for the registration of geographical indications and denominations of origin of the European Union in Argentina.
The aforementioned Resolution identifies the grounds for opposition that may be invoked in regards to geographical indications or denominations of origin of the European Union, where we can find the following: That it is a generic name of the product, that the same can lead to error regarding the qualities and characteristics of the product, that it is a name identical or similar to another one already registered as a Denomination of Origin which can mislead the consumer in regards to the true identity of the product, amongst others.
If any objection is raised against the application, the representative of the European Union will be given a period of 30 days to present the arguments that he considers necessary.
The protection of geographical indications and denominations of origin of the European Union in Argentina will depend on the successful negotiation of the Free Trade Agreement.
