PROPOSAL TO ELIMINATE THE BACKLOG OF PATENT APPLICATIONS
The Patent Office of Brazil and the Brazilian Ministry of Industry and Commerce issue a drastic proposal to eliminate the existing backlog of unexamined patent applications.
The proposal provides that unopposed patent applications will be automatically allowed, without any examination, in a 90-days term.
A patent application in this program must meet the following requisites: the filing date must be until the date of the enactment of the proposal; a published patent applications or petitions for anticipated publication up to 30-days of the enactment of the proposal; examination request filed up to 30-days of the enactment of the proposal; payment of annuity fees must be in good standing; no technical opinion should have been published yet.
