NEW BILL OF PERSONAL DATA PROTECTION
After being approved by the Senate and the Chamber of Deputies in Brazil, the new bill regarding personal data information is waiting for the presidential sanction
One of the main topics relies on the data that the companies may collect because, on the one hand, companies must only collect the necessary information for the developments of the services and, on the other hand, users will be able to request the collected data, as well as to ask for its corresponding correction or exclusion. The rules aim to be enforceable for both the public and the private sectors, and those that fail to comply will face sanctions ranging from fines to the suspension of the database activity.
Although the project searches for a new legal framework for the protection, treatment and use of information, the Central Bank and Ministry of Finance have criticized the device that requires the personal data processing to be done with the owner’s consent, since they argue it compromises the operation of positive registration, that is, the database of the “good payers”.
