BOGOTA’S JUDICIAL DISTRICT SUPERIOR COURT CONFIRMS THE AUTHORITY OF THE NATIONAL COPYRIGHTS DIRECTION (DNDA) TO PRACTICE EXTRAPROCEDURAL TESTS

Bogota’s Judicial District Superior Court confirmed the authority of the Colombia’s National Copyright Agency (DNDA) to practice extraprocedural tests by means of the decision issued in file No. 20160153100.

 

The mentioned decision was based on Law 1564 of 2012, which states that administrative authorities such as the DNDA may exercise judicial functions, when the mentioned processes are related to copyright and other related rights.

The Court noted that the jurisdictional powers granted to administrative authorities comprise the same prerogatives performed by a judge. This measure is also adopted to relieve judicial congestion.

Thus, it was confirmed that the DNDA has a permanent and special ability to decide issues concerning copyright and other related rights, and may practice of extraprocedural tests for this purpose.
