INTELLECTUAL PROPERTY CRIMES
The Colombian Criminal Code foresees the following crimes related to Intellectual Property: misappropriation of trademarks and patents, illegitimate patent use, violation to author moral rights, fraud to author economic rights and violation of the protection mechanisms of author economic rights
Misappropriation of trademarks and patents is punished with prison of two (2) to four (4) years and fines between twenty (20) to two thousand (2,000) statutory monthly minimum wages.
Illegitimate patent use is punished with prison of one (1) to four (4) years and fines between twenty (20) to one thousand (1,000) statutory monthly minimum wages.
Violation to author moral rights is punished with prison of two (2) to five (5) years and fines between twenty (20) to two hundred (200) statutory monthly minimum wages.
Fraud to author economic rights is punished with prison of two (2) to five (5) years and fines between twenty (20) to one thousand (1,000) statutory monthly minimum wages.
Likewise, the violation of the protection mechanisms of author economic rights is punished with fines.
