NOTORIOUS TRADEMARK PROTECTION DEMANDS SIMILARITY BETWEEN THE CONFLICTING SIGNS
Even though notorious trademarks must have a greater protection against risk of confusion or association, the Trademark Office demands similarity between the notorious trademark and the sign against which an opposition is filed.
The Trademark Office recently granted registration for trademark RLX RALPH LAUREN in classes 9, 14, 18 and 25 in the name of THE POLO/LAUREN COMPANY, despite the notoriety of Trademark ROLEX in class 14, arguing that the conflicting trademarks shared no similarities that could cause risk of confusion or association.
