ISSUANCE OF LEGISLATIVE DECREE FOR THE SIMPLIFICATION OF INTELLECTUAL PROPERTY ADMINISTRATIVE PROCEEDINGS
Legislative Decree No. 1309 for the Simplification of Intellectual Property Administrative Proceedings carried out before the deciding bodies of the National Institute for the Defense of Competition and Intellectual Property (INDECOPI) was recently published with the purpose of streamlining proceedings in order to promote the development of economic activities and improve the quality of services delivered.
Several articles of Legislative Decree No. 1075, which approves the Complementary Dispositions of Decision 486 of the Commission of the Andean Community were modified in order to speed-up industrial property proceedings. Copyright related procedures were also simplified with the modification of the Copyright Law (Lay No. 822).
In order to improve designation of origin positioning at national and international levels, the Framework Law of the Regulatory Councils of Designations of Origin (Law No. 28331) was modified as well. For this purpose, associative practices were strengthened together with control mechanisms for the effective managing of designations of origin.
INDECOPI’s operating regulations must be modified in order to incorporate all corresponding modifications and the Executive Authority must also issue the relevant statutory provisions.
