COLOMBIA, ARGENTINA, BRAZIL, CHILE, ECUADOR, PARAGUAY, PERU AND URUGUAY AGREEMENT TO ALLOW ACCESS TO PATENT PROSECUTION HIGHWAY (PPH)
Representatives of the Industrial Property Offices of Argentina, Brazil, Chile, Colombia, Ecuador, Paraguay, Peru and Uruguay met with the intention of releasing a joint statement to initiate the execution and implementation of the Patent Prosecution Highway (PPH) pilot program.
Among the advantages of the PPH is that the Intellectual Property Offices of other member states will take into account all favorable decisions issued by any of the Patent Offices of the mentioned countries, which will clearly benefit applicants.
With this agreement, patent and utility model application processes will be faster and their associated costs will also be reduced, since it will no longer be necessary to replicate actions such as searches and patentability exams in the different Patent Offices.
The implementation of the agreement is to be carried out in accordance with the guidelines set forth by the Industrial Property Offices which will establish the requirements and conditions for participation in the pilot program. The program will have a test period of three years and may be extended for an additional year until its definite implementation.
