COLOMBIAN TRADEMARK OFFICE CONCLUDES THAT THERE IS NO RISK OF CONFUSION OR ASSOCIATION WITH A NOTORIOUS SIGN, IF THERE IS NO EXISTENCE OF COMPETITIVE CONNECTION BETWEEN PRODUCTS AND SERVICES

The Colombian Trademark office considers that there is no risk of confusion or association with a notorious sign, if there is lack of competitive connectivity between products and services.

 

Through Resolution No.67674 issued on October 11th 2016, the Colombian Trademark Office considered it appropriate to compare the products and services of the conflicting signs to conclude that the same did not share any competitive connection and therefore would not cause confusion among consumers nor would it present an unfair advantage of the notorious sign, or the dilution of distinctive force or commercial or advertising value, which do not arise from the notoriety itself.

Consequently, the mentioned authority considered that there is no risk of confusion or association with a notorious sign, if there is lack of competitive connectivity between products and services.
