ISSUANCE OF LAW THAT ALLOWS USE OF ABBREVIATED CRIMINAL PROCEDURE IN CRIMES AGAINST COPYRIGHT AND INTELLECTUAL PROPERTY

On July 13th 2017 came into force Law 1826 of 2017 by means of which a new abbreviated criminal procedure was introduced, applicable to some offences including those related to Intellectual Property, and copyright.

 

Among the offences are the violation of moral and patrimonial rights of author and related rights, as well as the usurpation of industrial property rights, and illegitimate use of patents.

 The new procedure entails a simplified procedure regarding ordinary criminal proceeding and includes the figure of the private prosecutor which allows the participation of the claimant’s attorney as accuser, being possible to assume faculties and obligations former in charge of the Attorney General.
