STREAMING SERVICES DO NOT GENERATE RELATED RIGHTS SINCE IT IS NOT CONSIDERED BROADCASTING.
Colombia’s Copyright authority (DNDA) determined that Streaming services that are provided through platforms such as Netflix, Spotify and others that are similar, do not generate rights ancillary to copyright. This is due to the fact that access to works protected by copyright through these services occurs on the internet and not through traditional radio waves.
Consequently, Streaming services that are aired over the Internet do not generate any related rights because they are not considered a broadcast. However, they do generate the right of making available since the content is accessible on the Internet for whoever wants to consult it.
