The Superintendence of Industry and Trade has published the official fees for the year 2016 carrying out the following important variations regarding patents and trademarks.
SUPERINTENDENCE OF INDUSTRY AND TRADE NO LONGER DEMANDS FILING OF SUPPORTING DOCUMENTS FOR CERTAIN RECORDALS IN TRADEMARKS OWNED BY FOREIGNERS
According to The Superintendence´s of Industry and Trade practice it is no longer necessary to file documents which support changes of applicant, domicile or address in the cases of trademarks owned by foreign applicants.
TRADEMARK OFFICE AUTHORIZES THE USE OF THE PROTECTED DESIGNATION OF ORIGIN OFFICIAL SEAL TO SELECT ARTISANS
The Colombian Trademark Office granted the use of the Protected Designation of Origin Official Seal to 40 artisans belonging to 12 different Colombian regions.
THE BRAZILIAN PATENT AND TRADEMARK OFFICE ESTABLISHES CRITERIA FOR A NEW PILOT PROGRAM FOR FAST-TRACK EXAMINATION OF PATENT APPLICATIONS
On January 5, 2016, the Brazilian Patent and Trademark Office issued Resolution 154/2015 which contains the guidelines of the pilot program for fast-track examination of Patent application through the PPH (Patent Prosecution Highway).
POSSIBILITY OF MEDIATION DURING THE TRADEMARK OPPOSITIONS STAGE
Through Rules No. 27.222 and 26.589 of Mediation and Conciliation and well as Trademarks and Commercial Designations, it is possible to put on hold the opposition´s life term in order to obtain mediation.
DATA PROTECTION FOR PHARMACEUTICAL FORMULATIONS
Legislative Decree No. 1072 only protects data protection for pharmaceutical formulations of chemical origin. In Peru the data protection of pharmaceutical formulations of biological origin are not yet protected.
