TRADEMARK OFFICE SETS REQUIREMENTS FOR NON-TRADITIONAL TRADEMARK APPLICATIONS

By means of Resolution No. 3718 of 2016, the Trademark Office instructed the requirements for non-traditional trademark applications: tridimensional, sound, color and tactile trademarks.

COLOMBIA

PATENT OFFICE STATES RULES REGARDING AMOUNT OF SUBSTANTIVE EXAMS

The Patent Office issued Resolution No. 3719 of 2016, stating that up to two additional substantive exams can be carried out provided that the deadline for the patentability exam is of less than 18 months counted from the publication date for patents, or less than 9 months from the publication for utility models.

BRAZIL, COLOMBIA AND PERU

ADVANCES IN THE IMPLEMENTATION OF THE PPH

As from January 1st, 2016, the PPH agreement in between Peru and Spain has entry into force. The purpose is to accelerate the patent applications prosecution in said country. The Brazilian Patent Office establishes the PPH to accelerate the substantive examination for the industrial designs. The Colombian Patent Office and the European Patent Office (EPO) have signed an agreement to implement the PPH.

AGREEMENT BETWEEN INVIMA AND MERCADO LIBRE

The Colombian authority INVIMA, in charge of controlling and monitoring the quality and safety of pharmaceuticals, medical devices, foods and cosmetics in Colombia, entered into an alliance with the online sales platform Mercado Libre, to strengthen the control over the sales of products that may not comply with health standards or whose advertising might be misleading to the consumer
