SEEKS TO ADD NEW LIMITATIONS AND EXCEPTIONS TO COPYRIGHT

Argentina’s Copyright authority and the Ministry of Culture invited all interested parties to discuss the draft that may modify the Argentinian copyright law adding new exceptions and limitations.

BRAZIL

BRAZILIAN PATENT OFFICE ISSUES RESOLUTION NO. 179 OF MARCH 1st 2017

The Brazilian Patent Office issued Resolution No. 179 of March 1st 2017 revoking previous Resolution 174, by the means of which confirmed that the assignment of the priority document signed after the PCT application’s filing date is valid.

NEW DECREE ON INVESTMENT OF FOREIGN CAPITAL OVER INTANGIBLE ASSETS

The Colombian Government issued Decree 119 of 2017, through which the foreign capital investment regime (formerly contained in Decree 1068 of 2015) was modified.

NATIONAL DIRECTION OF COPYRIGHT (DNDA in Spanish) LAUNCHS THE “ORANGE NET”

With the launch of “ORANGE NET” the National Direction of Copyright (DNDA in Spanish) wishes to give the possibility to different Colombian creators to publish short summaries of their work in order to be contacted by interested third parties or different industries, and thus promote the monetization of their creations.

PRESCRIPTION OF MEDICINES IS AUTHORIZED FOR INDICATIONS NOT INCLUDED IN THE HEALTH REGISTRATION “OFF LABEL”

On February 28th, the Colombian Ministry of Health issued Resolution no. 532 of 2017, whereby it authorized the prescription of medicines whose indication is not included in the health registration issued by INVIMA, known as prescription of off label uses.

Recently, a modification to the Mexican Industrial Property Law entered into force, which modified some formal procedures.

PERU

ISSUANCE OF LEGISLATIVE DECREE FOR THE SIMPLIFICATION OF INTELLECTUAL PROPERTY ADMINISTRATIVE PROCEEDINGS

Legislative Decree No. 1309 for the Simplification of Intellectual Property Administrative Proceedings carried out before the deciding bodies of the National Institute for the Defense of Competition and Intellectual Property (INDECOPI) was recently published with the purpose of streamlining proceedings in order to promote the development of economic activities and improve the quality of services delivered.

VENEZUELA

TAX UNIT INCREASE

On February 24th 2017, the increase of the value of the Tax Unit in Venezuela was made official by the publication of the new rate in the Official Gazette No. 6287. The latter implies an increase of around 70% of the rates that foreign industrial rights owners must pay in regards to the different services provided by the Venezuelan administration.
